EEOC Jurisdiction for GINA Title II

WASHINGTON, DC-- The recent US Equal Employment Opportunity Commission press release, “Historic Genetic Information Nondiscrimination Act Takes Effect”, explains the EEOC’s enforcement role and responsibilities under Title II of the Genetic Information Nondiscrimination Act (GINA), marking the first legislative expansion of EEOC jurisdiction since the Americans with Disabilities Act (ADA) was passed in 1990.

GINA has critical implications for people with genetically-determined disabilities and people with family histories of genetic conditions. In particular, according to the EEOC, "an employer may never use genetic information to make an employment decision because genetic information doesn't tell the employer anything about someone's current ability to work."

Jordan Thomas- CNN Top 10 Hero

Jordan Thomas was recently chosen as one of this year's "Top 10 CNN Heroes" for his work with the Jordan Thomas Foundation, which he founded at age 16 and has since raised more than $400,000 to provide prosthetics for children in need. Thomas, a double amputee himself, will be awarded $25,000 - and is eligible for the $100,000 award that will be bestowed upon the CNN Hero of the Year later this month at a star-studded gala in Hollywood. Disability Included Under Hate Crime Protections


US-- S. 909, the Matthew Shepard Hate Crimes Prevention Act (HCPA), included in S. 1390, the National Defense Authorization Act for Fiscal Year 2010 HAS PASSED THE SENATE. It will now head to President Obama for signature.

Under this measure, federal hate crime law is expanded to cover offenses based on a victim's gender, sexual orientation or gender identity, or on a disability.

Several controversial amendments proposed to S.1390 by Senator Jeff Sessions (R-AL) and John Thune (R-SD) also passed the Senate. Senator Sessions' amendments allow the death penalty in certain cases involving hate crimes and gives the Attorney General the ability to set the criteria that determines if a hate crime has been committed. Senator Thune's amendment allows state-to-state reciprocity for concealed weapon permits.

Sotomayor Diabetes Debate Heats Up- For the Wrong Reasons


President Obama’s pick for the US Supreme Court, Sonia Sotomayor, has Type I (Insulin Dependent) Diabetes. Sotomayor’s health and medical fitness for the top court position, along with diabetes more generally, is now the topic of hot political debate. The debate is likely to continue for weeks if not months, as Sotomayor’s diabetes becomes a national dinner table topic. Ominously, Time Magazine notes, “the potential for a catastrophic complication—by no means unique to her situation—highlights a serious deficiency in the nation's oversight of Supreme Court justices”.

It is difficult to read the increasingly alarmist coverage of Sotomayor’s health without catching strong whiffs of existential angst—that free-floating (and prejudicial) feeling of “discomfort, anxiety, defensiveness… experienced because of the fear of acquiring a disability”—so well described by Smart & Smart (2007). Clearly and regrettably the medical model of disability is alive, well, and being advanced by politicians and pundits of all sorts! What a shame so few of our opinion leaders and public figures are taking Sotomayor’s nomination as an opportunity to positively reframe not only diabetes, but also disability.
Come on, pols and pundits! Sotomayor gives us a great opportunity to discuss what people with chronic illness CAN do. Accurately and fairly reported, her experiences may reduce some myths about diabetes and insulin, and put positive, hopeful, and realistic information about Type I diabetes in the public eye. Hmm... a discussion of job accommodations and the ADA would be appropriate right about now, too.

NY Governor Blasts Saturday Night's “Cheap Laughs”


Is it time for a Saturday Night Live Boycott?


New York Governor David A. Paterson blasts the TV comedy show Saturday Night Live (SNL) for the recent and ongoing skits about his blindness. The show mocks the Governor’s blindness and repeatedly him as clueless and bumbling. Paterson notes that his portrayal on the show degrades not only him, but also all people with disabilities, creating and perpetuating negative stereotypes and attitudes toward people with disabilities.

Paterson notes that 71% of people who are blind are unemployed, and 90% of people who are Deaf are unemployed, despite outperforming non-disabled individuals educationally. This, the governor says, is evidence that “one of the biggest problems finding work for the disabled are attitudes."


New York Times columnist Clyde Haberman says SNL is treating Gov. Paterson “as if Mr. Paterson were Mr. Magoo come to life”. Paterson, the former lieutenant governor, took office March 17, 2008 after Eliot Spitzer's ouster due to involvement in prostitution. Gov. Paterson is New York’s first African-American governor, and the second blind individual to serve as a governor anywhere in the US.
